Study On Difficulties In Drug Crime

With the rapid development of our country's economy,drug crime is becoming more and more serious,mainly because of the endless emergence of various new drug types,the frequent occurrence of new drug cases,and the emergence of more and more new problems associated with some traditional drug cases.Because of the new problems,the shortcomings of the legislation and theory of drug crimes are gradually exposed,and there are still some shortcomings in the identification of the difficult problems of the related drug crimes.The full text is divided into four parts,a total of about 39000 words.Part I: Overview of drug crimes.In the first part,the factual and legal concepts of drugs and the related concepts of drug crimes are discussed respectively.This paper analyzes several important characteristics of drug crime,and makes a deep understanding of the current legislation and judicial practice of drug crime.The second part: the qualitative analysis of several difficult situations in drug crime.Focusing on the in-depth study on the difficult behavior of "drug detection at the residence and other places",drug intermediation and drug crime committed by drug addicts in drug-related crimes,and understanding the judicial status and shortcomings of each kind of problem to a certain extent.The identification of this kind of difficult problems is explained,and some reasonable standards are put forward for different types of drug crimes.Part three: subjective intention and accomplice of drug crimeA study of the subject.First introduced the current drug subjective intent and the problem of complicity in the judicial problems faced by the next in-depth analysis of the subjective intent of the identification of the relevant conclusions and finally the accomplice question related to the same detailed elaboration.The fourth part: the problem of identifying the amount of drug crime.In this chapter,not only the related problems of the amount of drugs are analyzed and explained,but also the starting point of the details of the amount of drugs and the necessity of drug purity identification are analyzed and demonstrated.At the same time,some suggestions are summarized.
