Oceans make up most of the Earth's surface,and a large proportion of these belong to the high seas that beyond the limits of national jurisdiction.The marine animals and plant resources are of immeasurable value to mankind,and the high seas have special biological diversity that other seas do not have.The survival and development of mankind cannot be separated from the support of natural resources,and the sustainable development of natural resources depends on the sustainable development of biological diversity.The biodiversity of the oceans is of particular importance,especially in the open sea beyond the limits of national jurisdiction.Since the high seas are outside the jurisdiction of any country,the principle of the freedom of the high seas has a serious impact on the sustainable development of the marine biodiversity.The high seas biodiversity is severely damaged,further undermining the high seas ecosystem.Eventually,human beings are gradually realizing the importance of the biodiversity of the high seas and come to realize that the protection of the high seas biodiversity should be carried out.The high seas biodiversity not only has the value of academic research,but also has the value of utilization.Human beings cannot live without the support of biodiversity.For the sake of intergenerational equity,we also need to recognize the importance and urgency of conserving the biodiversity of the high seas.Based on the analysis of the existing legal system,this article finds that there are problems in it,and puts forward some solutions.This paper first outlines the conservation of the high seas biodiversity and clearly defines the concept of biodiversity conservation in the high seas and the development of its protection.Second,clarify the need for the conservation of the high seas biodiversity and why it is protected by international law.Thirdly,this article highlights some of the problems in the international law of biodiversity conservation in the high seas.It mainly analyzes the main international treaties and expounds the insufficiency of current biodiversity conservation in the high seas by analyzing the treaty's legislative and enforcement defects.Fourth,analyze the current international law's position on the protection of the high seas biodiversity to deal with the existing problems in the protection of the high seas biodiversity.Finally,combined with China's position on biodiversity conservation in the high seas,it analyzes China's challenges in biodiversity conservation in the high seas and puts forward how China should respond.In this paper,the current international community on the issue of research,and from the actual situation,in order to make China better response to the current development of the protection of the high seas biodiversity put forward the following suggestions: First,actively participate in the negotiation and the formulation of a new agreement;Is to strengthen the study of the protected areas of the high seas;third is to carry out extensive international cooperation.It is hoped that this article can provide reference for the conservation of the high seas biodiversity and contribute to the development of China's protection of the high seas biodiversity.
