Research On Application Of Self-defense

Self-defense system reflects its protection to the citizens in the Chinese Criminal Law.The system with rich theoretical knowledge is stipulated in only three clauses,and with difficulty in judicial case application.Scholars try to further theoretical research on the system by YuHuan V.Du in 2017,some legal concepts’ in the system remain controversial.This thesis strives to solve the controversy in the case on the basis of judicial application and research results.In chapter one,this thesis was summarized the the basic facts and controversies of YuHuan V.Du and listed the standpoints of some scholars.In chapter two,this thesis was uncovered the reasons why some problems in judicial cases of self-defense.In chapter three,this thesis was ’studied on the legal theory on YuHuan V.Du that dealt with controversies.In chapter four,this thesis was made an conclusion on YuHuan V.Du and put forward some thought to judicial application of the system.
