According to the article 9 of the Constitution and the single line resource laws,all mineral resources,waters,forests,mountains,grassland,unreclaimed land,beaches and other natural resources are owned by the state.The natural resources owned by state have one or more attributes of natural economy,scarcity,public welfare,and ecology.These attributes determine that these natural resources rights to use cannot be configured in a single way.Based on Article 53 of the Administrative Permission,C hina establishes a market-oriented competitive transfer method as the main method,and the government's non-competitive transfer mode of interventio n,is an important complementary transfer mode framework.O verly wide coverage of market-based competition will result in the loss of social public interests and the destruction of the ecological environment.The non-competitive approach of government intervention will result in inefficient allocation of resources and power-seeking behavior.Therefore,it is necessary to use market failure as the sole criterion for government intervention.To clarify the status of the two modes of transfer,to further coord inate the operations of the two in the practice,and to realize the construction of the primary market for transfer of state-owned natural resource use rights.
