As “punishing crimes and protecting human rights” of criminal procedural concepts have become more and more popular,the group of defense lawyers has become a target of concern for all walks of life.As defenders of the rights of defendants,defense lawyers need to perform their defense duties with dedication;as defenders of judicial justice and seekers of social justice,defense lawyers also need to assume public functions,and every move must be done so as not to harm the social organism.However,due to some drawbacks in China's criminal justice system and lack of good professional morals of defense lawyers,the judicial chaos in which delinquents are accused of misconduct become increasingly fierce today,and a large number of non-standard out-of-court situations gradually appear in public view.If the criminal defense lawyer's extrajudicial statements occurs within an appropriate limit,not only can contain judicial injustice which by the public authority's abuse of power,but it can also promote the criminal justice system to operate on the correct track;if lack of the reasonable regulation,it will backfire,not only failing to safeguard the legitimate rights and interests of the parties,but also undermining the construction of the legal professional community and even threatening the construction of the country ruled by law.Therefore,based on the current status of criminal justice in China,we should actively learn advanced experience from the foreign countries and discriminate against the different types of extrajudicial statements to give full play to their positive effects and restrain their negative influence.Ultimately,it promotes the comprehensive standardization of criminal proceedings.
