The View Of The Emerging Rights Of Euthanasia

Under the background of the new era,the traditional rights have many new concrete right problems,and the new social relations require the addition of new members in the “right family”,and the new rights are increasing day by day.The existing rights stated in the legal provisions are only an incomplete list of rights,and the development of rights is dynamic.The existence of certain rights cannot be denied because the law is not expressly stated,nor should they be excessively affected by the “rights-based theory”.So that some new claims are naturally brought into the concept of emerging rights.In the past 30 years,with the comprehensive deepening of reform and opening up in China and the introduction of euthanasia bills in some foreign countries,a series of discussions on euthanasia have been conducted in the academic circles in China.Scholars are more likely to demonstrate the feasibility of euthanasia legislation from the perspective of the right to be,ethics,and the foundation of civil law for euthanasia.From the perspective of analyzing the property of rights,this paper demonstrates that euthanasia which is defined in this paper accords with these rights attributes and euthanasia is an emerging right.And by listing the development process of euthanasia at home and abroad,relevant legislative proposals are put forward.In short,euthanasia needs to be further explored and deepened both in theory and in system design,so that people can listen to their own heart and peace to death at the last moment of their lives.
