Study On The Crime Of Infringing On Citizen's Personal Information

The Criminal Law Amendment(9)of the people's Republic of China integrates the crime of illegally providing citizens' personal information with the crime of illegally obtaining citizens' personal information as a crime of infringing on citizens' personal information.The crime of infringing on citizens' personal information includes the illegal provision of citizens' personal information and the illegal acquisition of citizens' personal information,in which the illegal provision of citizens' personal information includes the acts of selling,publishing,etc.The illegal acquisition of personal information of citizens includes purchasing,receiving,exchanging,collecting and so on.However,the behavior of infringing citizen's personal information can not be effectively curbed,and the illegal use of citizen's personal information cannot be regulated by the current criminal law.The illegal use of citizens' personal information is the same as the illegal provision and illegal acquisition of citizens' personal information.On the one hand,it has the nature of violating legal interests,and the civil and administrative means are not strong enough to crack down on it;on the other hand,It is necessary and feasible to regulate the illegal use of citizens' personal information.Finally,it puts forward the legislative suggestions to regulate the illegal use of citizens' personal information,in the hope that it will help to perfect the crime of infringing on citizens' personal information and lay a strict criminal law network for the protection of citizens' personal information.
