Commodity reputation is a kind of intangible wealth of the production operator.It is market economy point of view of positive evaluation production operator's ability and the quality of the goods,goods damage others reputation of ACTS of unfair competition not only causes economy severely damaged,but also can destroy and orderly market economic order.Therefore,China's new criminal law stipulates that the crime of damaging business reputation and reputation of goods is a crime of disrupting the market order.With the continuous development and improvement of China's market economy,judicial practice has changed the crime of commercial reputation and commercial reputation into a common criminal law.It's getting a lot of attention.Based on the theory of criminal law and related crimes,this paper conducts a preliminary study on some basic problems of commercial reputation and commercial reputation.Article first to define commodity credibility,this paper expounds the concept and characteristics of commodity credibility and then analyzes the credibility of the economic value of goods,merchandise credit for commodity managers hold great economic value and must to punish the infringing goods reputation infringement.Secondly,the article expounds the damage goods reputation "fabricated and spread" the concept of the behavior of the explanation,the author combining the Angle of legislation,judicial practice and academic theory to illustrate "fabricated and spread" behavior.Then,the author further discusses the judgment of the purpose of crime.In the end,the article focuses on the determination of "heavy loss" and "other serious plot".The author hopes that through the discussion of this article,it will be helpful to improve the related provisions of this crime in the future.
