Research On Litigation Request Of Consumer Civil Litigation

Consumer civil public interest litigation,as an important litigation model for consumer rights protection,is a key component of building a diversified consumer protection legal system.Consumer civil public interest litigation is different from consumer private litigation filed by individuals.One of the important differences is the litigation request of the parties.The litigant's request is the claims of litigation rights and the object of the court's referee.It is important in litigation.This article discusses the litigation request of consumer civil public interest litigation from five parts:The first part introduces the historical origins of consumer civil public interest litigation.It discusses the special significance of public interest litigation to protect consumers' rights by describing the causes of consumer civil public interest litigation and comparing it with consumer private interest litigation.The second part discusses the factors influencing the protection of consumers' rights and the litigant's request of public interest litigation from the aspects of litigation subject,the relationship of consumer civil public interest litigation and private interest litigation,substantive rights basis,national culture and nomocracy tradition,and explores its situation that should be theoretically.The third part compares the types of litigation requests abroad by using the method of comparative research,and provides reference for the system design of the litigation requests of consumer civil lawsuits in our country.The fourth part elaborates the legislative status quo of our country's consumer civil litigation lawsuit and the cases in judicial practice.It analyzes the shortcomings of the existing system and establish the foundation for perfecting the system.The fifth part,based on a jurisprudential analysis of the litigation requests of consumer civil public interest litigation,combined with the advanced experience of foreign countries and the current status of domestic development,put forward suggestions for the improvement of existing litigation claims system and analyzes the litigation requests in dispute among scholars.
