On The Compensation Of The House Being Dismantled

Housing demolition is the inevitable result of China's rapid economic development and urban expansion.Housing demolition will inevitably result in conflict of interests and legal adjustment.At the same time,with the continuous enhancement of the concept of civil property of the state and individual,the protection of the rights of the house demolished has become the most important part of housing demolition.In the existing legal system system,the property law,the land management law are more detailed.The forty-second articles of the property law clearly define the premises and the compensation standard of the housing demolition.The regulations on compensation for demolition and compensation are applicable to the behavior of housing demolition compensation in the city.The land management law is the main application of the compensation for the demolition and compensation of the houses on the rural collective land.The promotion of demolition activities should be based on ensuring that the compensation result of the demolished people is reasonable and fair.It can be found that the system of housing levy compensation gradually normalize public power,and at the same time,it also strengthens the protection of the legitimate rights of the house demolished.However,the existing law and Order Ordinance is still difficult to solve all kinds of compensation disputes in housing demolition.The main body of this thesis is divided into five parts.First,it introduces the basic concept and characteristics of the compensation system of the house being removed,and makes a comprehensive understanding of the system of housing demolition compensation and analyzes the development process of the system.The second part expounds the compensation system of housing demolition in developed countries,focusing on the definition of the public interest and the value evaluation method of the compensation,and the enlightenment to our country.The third part introduces the main problems of the housing demolition compensation system in our country.The fourth part is the focus of this article,and the combination of theory and practice is used to improve the system.Finally,we draw a conclusion.
