In traditional civil cases,divorce cases are the most typical and most common.In recent years,with the continuous development of the social economy,the concept of marriage and family has also changed,leading to an increase in the factors of instability in the marital status,and the number of divorce cases accepted by the grass-roots courts has also increased year by year.As we all know,the divorce case not only involves the spouse's feelings of both parties,but also is closely related to issues such as child support,husband and wife joint debt and common property division.Among the civil cases handled by the S County People's Court in recent years,the divorce cases accounted for the largest proportion.In the current judicial practice,the basic courts have encountered some problems in the handling of divorce cases,such as new difficulties in the delivery of documents,the application of procedures,the closing methods,and the results of physical processing.The legal divorce standards are not clear enough,leading to discretion of judges.It is difficult to grasp the space,divorce lawsuits on the evidence of the party's emotional breakdown,difficulties in obtaining evidence,litigation divorce indefinite trial and so on.Therefore,it is necessary to innovate the way of delivery,to be careful with the system of trial by default,to combine the evidence of the court and the litigant,to further clarify the standard of the legal divorce,to formulate the relevant laws and regulations for the state to raise or to rearing,to consider the exercise of the right of visit as appropriate,and to follow the best principle of the interests of the husband and wife.To establish a diversified mechanism for resolving marital disputes,with a view to providing assistance to China's grassroots courts in handling divorce cases in the future.
