Research On The Legal Problems Of False Divorce

In recent years,China began to enter the high-speed economic and social development stage,rapid development has also brought some disadvantages,because our country marriage management system is not perfect,the emergence of false divorce phenomenon,and with the development of economy,the phenomenon of divorce is gradually warming up,gradually with the popular "trend.The appearance of this phenomenon not only reflects the decline of the national moral standard and quality,but also reflects the imperfection of relevant laws in our country,and it has a certain impact on our social public order.The frequent occurrence of false divorce has aroused the attention of the state and society.It has also attracted many scholars’ discussions.Our legislation is still lacking the standard of false divorce behavior,which is mainly reflected in the relevant provisions of the marriage law and the general principles of civil law.This paper is divided into three parts to analyze the problem of false divorce.The first part is about the concept of false divorce and the reasons for its formation.By analyzing the social phenomenon,the reasons for the formation of the false divorce tide are drawn,which lays the foundation for the adverse effects of the false divorce below.The second part lists the adverse effects of false divorce,and then leads to the reason that the false divorce will have an adverse effect because of the effect of false divorce.The third part is based on the false divorce effect in view of the problems of the legislation abroad,put forward a divorce censorship and remedial measures of the solution,and learn from the foreign marriage and family system,combined with the current marriage law of our country was established,for China’s marriage system loopholes and shortcomings,improve the domestic on the marriage law of the legal system,the purpose of this is to enable citizens to exercise the right to freedom of marriage within the legal framework,the author’s point of view is to support China’s freedom of marriage,but not entirely free,make up the loopholes,establish the legal system of divorce to more stringent in order to reduce and prevent the emergence of this kind of false divorce phenomenon.
