Along with the continuous progress and development of modern economy,people's material life level and spirit level is rising,and the science and technology complement each other in development continuously by leaps and bounds,the artificial reproductive technology is accompanied by the proportion of the population of medical treatment of infertility cases emerged rising in natural fertility a part of the problem is replaced by artificial technology,to achieve the ultimate purpose of reproduction.The widespread application and extension of artificial reproduction technology has solved a series of legal problems in solving the problem of fertility for people with reproductive difficulties.Artificial reproduction technology,as the name implies,means that when traditional sexual combination and natural reproduction methods fail to achieve the purpose of childbearing,one link will be replaced by artificial technology to achieve fertility.Artificial reproductive techniques mainly include artificial insemination,in vitro fertilization and embryo transfer technology and surrogate derivative technology,these technologies in helping infertile patients solve fertility problems at the same time also accompanied by some problems caused by the dispute,the relevant provisions of the artificial reproductive technology existing in our country law less,directly led to the dispute application of artificial reproductive technology in the process of the lack of a clear legal basis.The parent-child relationship of artificial reproductive technology this paper mainly discusses the legal problems mainly include frozen embryos,legal attribute and ownership rights and the artificial reproductive technology under the identified two major points,this paper summarized and a brief analysis of the problems with two cases,the provisions of the actual case law and the combination of some legal problems caused by the artificial reproductive technology,and based on the present research situation about the legal problem of artificial reproduction,summed up the deficiencies,seek for improvement,to expect from the legal level to promote the healthy development of artificial reproductive technology,effectively protect the interests of minor children,the protection of the family and society to survive,to promote the harmonious and stable social development.
