Research On The Admissibility Of Judicial Expertise

Admissibility is the core concept of Anglo American evidence law.Admissibility research is a kind of proving ability to solve the qualification of evidence from procedure.The breakthrough of admissibility is not only a breakthrough to the evidence opinion,but also a maintenance of the just rule of law,which essentially restores the truth of the case.With the progress of the times and the remarkable improvement of the quality of the citizens,the opinions of judicial expertise have been able to effectively solve the difficult problems caused by the court cases.Nowadays science and technology is the first productivity,the Internet technology has spread to the judicial activities,,under the leadership of President Xi,the just judiciary is still the first priority.How to ensure the integrity of procedures and content is constantly being perfected and demonstrated.The admissibility of forensic opinion is the most important issue,which not only affects the value of the evidence itself,but also affects the progress of the whole litigation process,and then affects the judgement of the judiciary.The judicial authentication opinions like many fish,the expert opinion into reliable evidence in court,the legal evidence does not shut out,so as to effectively improve judicial efficiency,improve judicial justice,ensure the case just in an orderly manner,in line with the spirit of the rule of law in china.This paper focuses on the judicial expert opinion admissibility of theory elaboration,emphasize the value of significance of the study on the admissibility of the relevant problems from the Zeng Qinghong case,the present situation and Enlightenment of insinuate.By comparing and exploring the development process of evidence law in the world,drawing lessons from the experience of two major legal systems abroad,and combining with the basic national conditions of China,we should make reasonable research and rebuild the evidence system suitable for the development of rule of law in China.This paper respectively from the judicial appraisal opinions by the factors outlined and influence factors analysis of the situation,two legal admissibility analysis and enlightenment,the admissibility of the system present situation and proposed solution four parts,hoping to play a role.
