Studies On Imprisonment For Life In China

In order to strengthen the punishment of the crime of corruption and bribery,The life imprisonment of no commutation and parole is established in the amendment of the criminal law of People's Republic of China(nine),which has aroused the attention of the society and the controversies of the scholars.Compared with the extraterritorial life imprisonment,China's provisions on life imprisonment are relatively simple.In order to better understand and apply to life imprisonment in China,based on the provisions of life imprisonment in China,through searching related books and references,using the method of comparative analysis,both inside and outside the domain of the life imprisonment were investigated.By doing these to analyze and demonstrate the existence and abolition of life imprisonment in China and the nature of life imprisonment in China.At last,the significance of the introduction of life imprisonment in China is discussed,and legislative suggestions on the perfection of life imprisonment in China are put forward in this article.This article is divided into four chapters to discuss our country's life imprisonment.The first chapter is an overview of life imprisonment in china.This chapter expounds the concept of life imprisonment and compares life imprisonment with life imprisonment in China.At the same time,the provisions of life imprisonment in China are analyzed in a standardized way.Finally,the influence of life imprisonment on China's criminal law system is analyzed.The second chapter is a comparative study of life imprisonment.It analyzes and collates the provisions of life imprisonment in the continental law system and the Anglo American law system,and analyzes the current judicial status of life imprisonment in China,and finally compares China's life imprisonment with extraterritorial life imprisonment.The third chapter is the theoretical question of life imprisonment in china.First,the positive and negative views on life imprisonment system in China's theoretical circle are analyzed.Second,The nature of life imprisonment in China is also discussed.The fourth chapter is the problems and suggestions for the introduction of life imprisonment in China.This paper expounds the problems of life imprisonment in China and puts forward the legislative proposals to improve the life imprisonment in China from three aspects.
