Research On Supplementary Investigation Of Prosecution

Supplementary investigation is a litigation activity that the Procuratorate returns the cases,which are unclear facts,lack of evidence,or omissions,omissions of co-accused,etc,to the public security organs or the investigation Department of the Procuratorate in accordance with the legal procedures,so that it can continue to investigate on the basis of the original investigation work.The purpose is to supplement the evidence so that the cases meet the prosecution standards or to improve the evidence chain better.Compared with other systems,the supplemental investigation system is a backward process,and it is an unusual process based on the special Chinese police and police relations.The existence of the system can improve the accuracy of punishing crimes,meet the needs of China's prosecutorial police power division,ensure the quality of investigations,and safeguard the fairness of justice.However,at the same time,because of its unusual nature,there are also many drawbacks,such as prolonging the detention time of suspects and infringing on their legitimate rights and interests.In light of the problems in the practical application of our country's supplementary investigation system,combined with the author's internship experience at a grass-roots procuratorate,this article focuses on the analysis of its causes,and from the reasons,proposes suggestions for improving the supplementary investigation system.
