The development of science and technology provides technical support for remote transactions represented by online shopping.Internet trading is rapidly developing with its unique advantages of unlimited time and space,the number of netizen continues to rise,and the amount of online transactions is also continuously updated.The growth rate of online transactions exceeded the growth rate of total social goods by three times,and it accounted for nearly one-fifth of the total sales volume of social products.The development momentum was strong,which played a significant role in promoting the development of the consumer market.However,online shopping is more risky than traditional trading methods.Before receiving goods,consumers usually know goods only through the sales web pages provided by the operators.In order to maximize profits,operators will inevitably hide adverse information.Consumers are at a disadvantage in market transactions due to weaknesses in economic strength and information volume,and information asymmetry in online transactions makes this gap worse.Consumers will regret that they are very different from their expectations after receiving the goods,but because of the lack of relevant laws,it is difficult for them to safeguard their legitimate rights and interests.In this context,the new "People's Republic of China Consumer Protection Law" was formally implemented on March 15,2014.Its groundbreaking introduction of consumer regret rights,to make up for legal loopholes in online shopping transactions,has been implemented for about four years now.On the one hand,society has developed rapidly.Many factors have not been considered at the time of legislation.On the other hand,due to the lack of supporting legal measures and imperfect legislation,coupled with a particular social environment,consumer regret power is difficult to achieve in practice.How to promote the prosperity of the online trading market is not only what economists need to consider,but also the task of legal scholars.Only by providing legal protection for consumers and eliminating worries can we promote the development of online consumption.There are mainly three parts in this paper.The first part is the introduction.It introduces the background of the article writing,the research purpose,the research status and methods,the literature review,the article writing ideas.The second part is the text of the article,including the first chapter,the second chapter,the third chapter,the fourth chapter and the conclusion.The first chapter liststhree cases,analyzes and summarizes the controversial issues in the case,and sums up three main issues of controversy: the first is the determination of the consumer's right to regret,and the second is the consumer's right to regret.The scope of application and the conditions of use of the dispute;the third is the legal regulation of abuse of consumer regret rights.The second,third,and fourth chapters respectively analyze and study the three aspects mentioned above.The first section of each chapter mainly analyzes the existing specific problems and disputes,and the second section of each chapter corresponds to put forward sound measures.The conclusion part is the author's summary of the article.The article believes that the law must balance the interests of consumers and the interests of the operators.In essence,it is the interests of consumers that the interests of the operators are ultimately damaged.Therefore,the improvement of consumer's right to regret should also take into account the interests of operators.The third part includes references,resumes and acknowledgement,and introduces the basic situation of the author's writing.
