Study On Some Problems Of Dangerous Driving Danger

The establishment of "Dangerous Driving Offences" in the "Criminal Law Amendment(8)" has reinforced the inadequacies of China's transport legislation in "traffic crimes" and "crimes against public safety crimes" and filled a shortcoming of the criminal law.The promulgation and implementation of the “Criminal Law Amendment(IX)” in 2015 made the dangerous driving crime once again entered the public's view.Since the crime of dangerous driving has achieved good social effects since it entered the crime,it has effectively curbed the occurrence of serious dangerous driving behaviors such as drunkenness,chasing races and so on.However,changes in the traffic situation have emerged with new types of dangerous driving behavior.In order to solve new road traffic threats and make up for loopholes in the law,the "Criminal Law Amendment(9)" has amended the dangerous driving offence,adding " Two dangerous and two dangerous driving behaviors.At present,the legislation on dangerous driving in China includes four items: drunk driving,chasing racing,over-speeding,and illegal transportation of dangerous chemicals.With the frequent occurrence of dangerous driving behaviors and the increasingly serious harm to society,it is impossible to completely and effectively regulate traffic offences and crimes by relying solely on the crime of traffic accidents and the crime of endangering public safety by dangerous means.Therefore,it is aimed at drunk driving,chase racing,overloading,and overloading.Whether dangerous types of dangerous transportation such as transporting hazardous chemicals should be thoroughly discussed in the academic circles of crime.Among them,the dangers of driving dangerous crimes and traffic accidents,and the dangers of harming public safety crimes by making contact with each other and differences are issues that need to be clarified.In essence,the inclusion of dangerous driving offences in the scope of criminal law regulation is not only a supplement to the original system of charges,but also a reflection of the principle of adaptability of crimes,punishments and punishments,and is conducive to the further protection of public interests.The article discusses the issues that have existed since the crime of dangerous driving was incriminated,discusses issues such as the crime of dangerous driving,the issue of accomplices,and the difference with other crimes in order to be able to grasp this type of crime more fully.We will safeguard our country's road traffic safety and protect the vital interests of the people in order to better guide judicial practice.
