The first chapter gives a brief overview of national defense,narrates the major classification on national defense,and paves the way for understanding the national defense in international law.The second chapter demonstrates the necessity of carrying out the regulation of international law on national defense.First of all,As the national defense has entered into the era of informationization,the national defense behaviors can make more substantial influence.Secondly,the lack of clear definition of the core elements of national defense can make national defense seeming aggressive,not defensive.Thirdly,as the competition among major powers has become more fierce and complicated and the international security cooperation has not taken effect,the security prospect is unstable.The third chapter mainly discusses the major theoretical issues related to the national defense.First of all,it explores the main reasons why the right to national defense is difficult to locate in the current international law.Then it focuses on whether it's in accordance with the principles of sovereignty,fairness and justice.The forth chapter makes suggestions on the basic principles of regulating national defense from the views of international value orientation.The state should exercise rights of national defense under the principle of maintaining the peace,taking into account of common security objectives.The expenditure on national defense should integrate with economic development,not excess the necessary needs.Superpowers should abandon the concept of seizing absolute security and take leads to abide by the international rules.The fifth chapter makes conclusion of the theme and opinions on THAAD issue.
