In 2014,the “blocking order” of the bad artists was adopted by the People's Republic of China State Press and Publication Administration,It is the Control measures of dealing with the chaotic behavior like drugs,prostitution,etc.To a certain extent,the measure reduce the negative impact on the society especially for teenagers of bad artist,many people support it,but many legal scholars question the legality of this administrative act.At the request of the rule of law,the administrative organ shall exercise administrative power according to law,It is the maintenance to the people's rights and interests,It requires the administrative organs to follow the basic principles of administrative law,and standardizes administrative actions strictly to ensure the rights and freedoms of the people.Study the “blocking order” from the perspective of administrative law is an important perspective.The “blocking order”is the behavior of administrative body who use administrative power,It embodies the game between public interest and private interest.First of all,research on its properties is a prerequisite for the analysis of “blocking orders”.Secondly starting from the legality principle,reasonableness principle and procedural legitimacy principle of administrative law to do in-depth analysis and elaboration on the background,procedures and social impact of the“blocking order”,It is found that the“blocking order”out of duty of the People's Republic of China State Press and Publication Administration,It also lacks the legal basis,rationality and procedure legitimacy,damaged the legitimate rights and interests of administrative relative person,the artists who were “blocked” and other interested parties such as advertisers,producers of movie and TV who is cooperated with “blocked” artist,It is not in accordance with the basic principles of administrative law and the requirement of the state to administrate the administrative organs according to law.
