CDS is called Credit Default Swamp,which is what we call Credit Default swaps.As a kind of financial derivative,its nature has gradually changed in practice,and its huge risk has been increased and caused the outbreak of the financial crisis in 2008.Chinese version of the CDS products launched on September 23,2016,marked the CDS has entered a new stage in our country,but as a result of the CDS market development is relatively slow and CDS itself risks,CDS products regulatory legal problems so more nots allow to ignore.This paper starts with the basic meaning of CDS,after this paper expounds the concept and its operation principle,mainly discusses the legal nature of CDS.And on the basis of the understanding of its nature,a better understanding of the function of the CDS,and exists in the legal risk,expounds the necessity of regulation on CDS.The second chapter,the article from the current regulations and regulatory model of the CDS,CDS regulatory status quo in China is analyzed,on the basis of carding the status quo,put the emphasis on regulatory mode and regulation of market operation.The analysis at present our country to CDS legislation,regulations and regulatory rules of trading in the deficiencies and problems.In the third chapter on foreign regulatory measures of the supervision model of CDS and the transactions are introduced.The author in the United States and Britain,for example,in comparing different regulation mode and transaction regulation,by comparing and analyzing to The Times.Finally in the fourth chapter,in CDS in China based on the research of the regulation of foreign experience,to establish a more secure,stable,efficient and transparent CDS supervision mode,clear the relevant regulatory agencies and regulatory authority in our country,and put forward the specific regulation of the CDS market trading and perfect measures.
