Study On Legal Issues Of The Protection Of Laborers' Right To Know

The laborers' right to know is a basic and precondition right of laborers which is an important research object in the field of labor law.As the cornerstone of protecting other laborers' rights and interests,it plays an important role in regulating the informing obligation of employers,clarifying the remedies,and realizing the effective protection and promotion of the harmonious employment relationship.However,at present,there are few articles studying on the protection of laborers' right to know in the academic circles.Based on the above considerations,the author summarizes the research results of relevant scholars and draws lessons from foreign countries' labor laws and regulations to improve the country's legislation and practical experience.Then the author sums up the problems existing in the practice,and this paper attempts to propose constructive and feasible suggestions for the solving these problems.Based on the comparative analysis and theory-to-actual methods which are used for this study,this paper is divided into four parts.The four parts are as follows.The first part refers to the basic theory of protection of laborers' right to know.Firstly,the concept and characteristics of the laborers' right to know are introduced.Based on the clarification of related concepts,it introduces and analyzes the constituent elements of laborers' right to know and the theoretical basis of protection.The second part is the foreign countries' labor laws and regulations on the protection of the laborers' right to know.Firstly,the paper introduced the legal provisions for the protection of laborers' right to information in the United States,Germany,France,Japan,etc.And then on the basis of reviewing the legislation of these countries,this paper summarizes the advanced experience that can be used for reference by our country.The third part sums up the regulations and existing problems in our country's laws regarding the protection of laborers' right to know.First,it points out that the content of laborers' right to know is incomplete because of the lack of the laws and regulations.Secondly,from the lack of restrictive provisions,it summarizes the lack of the legal responsibilities and the legal remedies.The fourth part is about improving the legal advice for the protection of the laborer's right to know.According to the third part of the specific problems,firstly,this paper proposes to improve the relevant legislation to provides the standard for the identification of the protection of the laborer's right to information;Secondly,we should clarify the restrictive provisions of the laborers' right to know and we should establish the legal liability for infringing on the laborers' right to know on this basis.Finally,through sound avenues of relief,we should improve the laborers' right to know and other labor rights and interests.
