Review And Perfection Of Criminal Quick Judging Procedure In China

Since the trial of the criminal quick judging procedure in 2014,the pilot area has been actively responding,giving full play to the subjective initiative,exploring new methods and new models,and accumulating considerable experience.So far,the quick judging procedure has become an important part of our criminal procedure.The criminal speed tailored trial has effectively improved the efficiency of the criminal procedure,improved the quality of the trial of criminal cases,optimized the allocation of judicial resources,carried out the criminal policy of temper justice with mercy,promoted the establishment of the multilevel and multilevel litigation system,and effectively implemented the system of confession and punishment.However,there are some problems behind the achievements made by the criminal quick judging procedure,which have revealed some problems,such as unclear positioning of the procedure,high rate of pretrial detention,inadequate participation of lawyers,and the impartiality of criminal sentencing standards in different places,which affect the impartiality of criminal procedure.The efficiency of discretion has caused obstacles.Combined with the problems encountered in practice,the article examines the useful experience of the criminal rapid process of Germany,Italian and other countries,and puts forward the way to improve the criminal tachytailor procedure in China.
