Research On Oral Evidence Applied In Civil Litigation

Oral evidence is an important evidence in civil litigation cases.However,there are currently few systematic studies on oral evidence in civil litigation.At present,there are many problems in the application of verbal evidence in civil lawsuits in China: Witness are reluctant to testify at court,party's statement to the court is often ignored,and our forensic system has drawbacks.Research on the application of oral evidence in civil litigation can provide solutions for existing problems and contribute to the construction of our legal system.This article has four chapters:Chapter ?,analysis of verbal evidence,mainly introduces the definition of verbal evidence,clarifies the related concepts of verbal evidence,summarizes the types of verbal evidence,analyzes the defects of verbal evidence,and summarizes the characteristics of verbal evidence;Chapter II,research on verbal evidence at home and abroad,mainly studies the research experience of verbal evidence in foreign countries and the historical development of verbal evidence in China.On one hand,my article investigates horizontally the legal provisions concerning verbal evidence in the two major legal systems.On the other hand,based on China's history of verbal evidence development,my article explores the features of verbal evidence system in our country.Chapter ?,problems existing in the application of verbal evidence in China.By collecting scholars' research reports and typical cases,we point out the problems existing in the application of verbal evidence at current stage in China and highlight the difficulties in the application of verbal evidence in China.Chapter ?,perfection of related systems concerning verbal evidence in our country's civil lawsuits.In the face of the predicament of current verbal evidence application,corresponding solutions are proposed,such as witness classification protection system,which provide solutions to strengthen the feasibility of applying verbal evidence in civil litigation.
