Protection Of Individual Rights In The Personal Internet Credit Investigation

The booming development of Internet finance has led to the demand for the personal credit investigation,and it has forced on the personal credit system which is dominated by the central bank.credit system,to take the system to a more diversified and marketable one.As the first batch of organizations to obtain the pilot qualification of personal credit investigation,many institutions have a close relationship with the Internet in terms of institutional nature and business model,so they are called Internet personal credit investigation.However,due to the lack of third-party independence and the serious problem of data island,eight institutions have not received the personal credit card license for three years.Under this background,led by the Internet banking association,the above eight institutions participated in the establishment of the Baihang credit institution,obtained the first personal credit card issued by the central bank,and formally started on the preparation.The establishment of the Baihang credit institution may solve the problem of data island and so on,but it still can't change the characteristics of the internet personal credit investigation.Internet personal credit bureaus in the process of data collection,processing,use easy to put the rights of information subjects at risk,and make the personal rights of the information subject faced by the risk of infringement.This paper analyzes the existing problems in the protection of information subject in the Internet personal credit investigation and puts forward relevant suggestions.Hope the information subject should be informed by perfecting the right of consent;the privacy protection is guaranteed by restricting the scope of information collection,the privacy protection is guaranteed;the right to know and the right to dissent is guaranteed through the construction of bad information correction path.And improve the relevant civil liability system.It is expected to realize the maximum protection of the rights of the information subject under the premise of ensuring the efficiency of credit collection activities.
