Comparative Study Of Archival Legislations Between The People’s Republic Of China And United States Of America

Archival legal construction is the ensurance of archival undertaking,and archival legislation.The research objects of the thesis are the archival laws and regulations which were made or recognized by the national authorities of these two countries,the research contents are constitutions,classifications and core contents of the laws and regulations,archival legislative basis.The research methods of the thesis are literature research,instance analysis and comparative research.The thesis describes the concepts of archival laws and regulations,archival legal system and archival legislation.With the description above,the thesis also states the scope of comparative research and the core content of archival laws and regulations.The thesis is divided into 7 chapters,Chapter 1 of introduction states the study background and significance of the thesis,the research status of domestics and overseas,the research thoughts,the research content and the innovations of the thesis.The definitions of concepts in chapter 2 include archival laws,archival regulations the archival legal system and the archival legislation.Taking the definitions of concepts as a standard,determine the scope of the comparative research.On account of legislation is the basis of archival legal construction,therefore,the comparative research of archival legislative basis of chapter 3 conduce to grasping the overall situation and completing the comparative study of archival legislations between China and U.S furtherly.The archival legislative basis are consisted of legislative ideas,legislative authorities,legislative principles,legislation evolutions and current laws and regulations.According to the definitions and some researches lead by scholars called Bofu Li and Zhonghai Chen,the first part of chapter 4 is stated with different legal validity hierarchy of archival laws and regulations in two countries.The second part of chapter 4 of categories of the archival laws and regulations is represented through functions and content with referring to the definitions.The similarities and differences can be concluded through the macroscopic compare of basis,hierarchies and species of archival laws and regulations which are proceeded systematically between China and U.S,the thesis can obtain achievements and inadequacies on the framework,legislative basis and content of the archival legislations in China,and bring up completion strategy.In conclusion,the thesis puts the summary and prospect of the research forward.
