With the continuous advancement of modern medicine,artificial assisted reproductive technology is constantly being improved.Surrogacy,as an artificial assisted reproductive technology,it completes the fertility process by using the uterus of other women,brings hope for infertile families to have children with their own bloodlines.With multiple causes of environmental pollution,life and work stress,and unhealthy lifestyles,the incidence of infertility is increasing year by year.Due to the influence of traditional reproductive ethics,most people still want their children to have genetic connections with themselves,thus promoting the development of the surrogacy market.The law of our country is still in the blank state in the regulation of surrogate.The Ministry of health promulgated the "human assisted reproductive management act" promulgated in 2001 and the "ethical principles of human assisted reproductive technology and human sperm bank" formulated in 2003,which prohibit the implementation of any form of surrogacy.However,as the demand of the general public continues to increase,illegal surrogacy such as underground surrogacy is not uncommon and surrogacy disputes are constantly increasing.Through analysis and comparison of foreign countries’ legislation on surrogacy,we found that,nowadays,most countries in the world have changed their legislation for surrogacy from a total ban to a limited opening.The initial realization of the legalization of non-commercial complete surrogacy has become a trend for legal regulation of surrogacy.Under the circumstances that the demand for surrogacy markets cannot be completely banned,combined with the advanced experience of foreign legislation,we should also respond to surrogacy as soon as possible in legislation.Moderately open surrogacy has a certain degree of rationality.It can not only reasonably control the limits of legalization of surrogacy,but also can make clear legal regulations on issues such as the contents of surrogacy contracts,the qualifications of surrogate parties,and the identification ofsurrogacy parent-offspring relationships.
