With the climate warming,sea ice in the Arctic Ocean thaws and the fish flow northward.In the future,the Arctic Ocean may form a new fishing ground.On the one hand,the Arctic Ocean leads to a new resource scramble.On the other hand,the lack of management system in the Central Arctic Ocean may lead to frequent disputes in the future.In the case of over-exploitation of global fisheries resources,to prevent the"tragedy of the commons",the Arctic Ocean,as the last piece of pure land on he Earth which has not been commercially exploited,should be exploited after the management.Therefore,the management system construction on the High Seas of the Central Arctic Ocean is imperative.The article starts from the general situation of the management on the High Seas of the Central Arctic Ocean,then analyzes the dilemmas of management and the way out of the dilemmas,at last it put forward some suggestions for China.The first chapter overviews the general situation of the management on the High Seas of the Central Arctic Ocean.It starts from the distribution of Arctic fishery resources under the situation of climate change,concluding that a new fishery may come into being at the Central Arctic Ocean in the future.Then,the article analyzes the current situation of management on the High Seas of the Central Arctic Ocean from there aspects:legal norms,organizational structures and their measures,and interest-related countries' management policies.The second chapter focus on the dilemmas of management on the High Seas of the Central Arctic Ocean and their deep-seated reasons.There are two dilemmas:one is the absence of pan-Arctic fisheries legal regulation,which mainly reflects in the lack of a unified system((legal norms are not targeted and "fragmented")and the function limitation of the organizations.The other is disputes between "interested States",which mainly reflects in differences of country interests and fishery management concepts among the Arctic 8.As to the two deep-seated reasons,one is the unpredictable development of the fishery resources at the High Seas of the Central Arctic Ocean and the other is the complex and volatile geopolitics in the Arctic.The third chapter explores the way out of the dilemmas.First of all,it proposes three major principles that should be adhered to:the principle of freedom of fishing on the high seas,the principle of precaution and the principle of sustainable development.Secondly,on the basis of the three principles,specific solutions are proposed----establishing a new international convention on the pan-Arctic high seas fishery resources and a regional fishery organization,and the article emphatically discusses the construction of the regional fishery organization.Finally,the article also noted that in the process of system construction,the rights of the indigenous peoples in the Arctic should be considered.The article analyzes the reasons of considering the rights of Arctic indigenous peoples from legal basis and realistic basis,their specific rights of Arctic indigenous peoples in the Arctic fishery,and specific protection measures for them.This is also a highlight of this article.The last chapter analyzes China's strategies to participate in the system construction on the High Seas of the Central Arctic Ocean from the international level and national level.Firstly the article analyzes China's practical activities in the the system construction on the High Seas of the Central Arctic Ocean from the perspectives of national policies,diplomatic relations,scientific research,institutional construction,and academic discussions.Then China shall participate in the system construction at least from four aspects:Firstly,adhere to the principle of freedom of fishing on the high seas;Secondly,promote the implementation of Agreement on enhancing international arctic scientific cooperation,deepen scientific diplomacy,and participate in the scientific research on marine biological resources in the Arctic Ocean;Thirdly,strengthen international cooperation,enact Arctic Fisheries Multilateral Cooperation Agreement timely;Fourthly,expedite the revision of offshore fishing regulations and improve China's fishery management system.
