At the end of 2017,China's mobile phone users reached 753 million,with the development of real-time delivery and the popularization of mobile payment,the integration of online information resources and offline business opportunities make the O2 O E-commerce model sustained development and permeate every corner of the people's lives.Takeout order,supermarkets,dyeing and washing,housekeeping service,beauty care,leisure and entertainment,travel,online education,retail experience...O2 O electronic commerce involves more industry and wider scope.O2 O E-commerce makes consumption more convenient and affordable,changes people's inherent consumption habits,which is the most popular E-commerce area currently.At the same time,O2 O E-commerce infringes consumer's rights and interests increasingly prominent,become the hardest disaster area for consumer complaints.The network market is not the place where outside the law,the Market Supervision Department,as the national market supervision and the Administrative Law enforcement Function institution,undertakes the responsibility of standardizing the transaction behavior of the network subject activity,protecting consumers ' rights and maintaining the order of network market economy.To protection the consumers ' rights and interests well under the O2 O mode,standardize the management behavior of O2 O subject market,which relate to the healthy development of the network economy and consumer's confidence in network consumption,it also have a strong realistic meaning to promote the orderly development of O2 O electronic commerce and to create a comfortable consumption environment.In this article,through carding the present O2 O electronic commerce development situation,the new problems during the develop process,the existence of infringe consumer's rights,Market Supervision Department of the current regulatory measures,from the legal system,jurisdictional mechanism,platform responsibility,cooperation mechanism,supervision and other aspects to targeted find the cause of the problem,Finally,from Market Supervision Department Perspective,this paper puts forward some Suggestions on the protection of consumers' rights and interests in the current O2 O e-commerce mode.The paper is divided into five parts;the first part is the concept of O2 O e-commerce model and related basic theory are summarized.In the second part,it mainly expounds the characteristics of our country's O2 O e-commerce mode,the difference between other e-commerce modes,the present developing situation and the new problems,through case analysis some typical problems of the O2 O e-commerce model.In the third part,firstly,it introduces the supervision and control measures of the O2 O e-commerce in our country,and then expounds the problems in the process of regulation and countermeasures.The Forth part,thinks about the protection of consumer rights and interests under the O2 O model.In view of the existing problems,combined with foreign advanced experience,from the promotion of O2 O e-commerce rights system construction,consummate the O2 O online complaints and after-sales rights mechanism,,strengthen the O2 O online integrated supervision,promote the establishment of O2 O consumption rights of the social common governance mechanism,This paper puts forward some countermeasures suggestions on speeding up the training of network trade supervision and the construction of network transaction supervision system in five aspects.The fifth part is to summarize and takes this as a starting point for the future of O2 O model consumer protection research.
