The Study On The Prison's Suggestions Of Criminal's Commutation In Our Prisons

The proposed procedure for commutation of prisons is the first link in China's commutation system.It is a way of reforming criminals and urging them to propose to change the sentence of sentences for criminals.It is an important guarantee for maintaining national security and stability,promoting society,and changing criminals.The system and procedures are accompanied by the continuous development of social development.However,the existing mitigation suggestions procedure in China still has imperfections in terms of legal provisions,and there are still irregularities in the operation of procedures.Nowadays,some prisons have more negative news.Because prisons are relatively closed and all kinds of information are not open to prisoners and the public,the execution of prison sentences and the protection of the human rights of prisoners have gradually become a hot topic in all walks of life.This article addresses the actual situation of the prison in the city of X and discusses the procedures for the proposed sentence reduction for prisons.After comparing the actual operation of the proposed mitigation proposal procedure with the legal provisions in the prison of the city of X,the main problems existing in the proposed commutation recommendation process of the prison have surfaced.For example,the criteria for commuting the proposed commutation is unclear and the score evaluation is irrational.Attention is paid to the issue of the reform of criminal labor,the circumcision of the prison system's internal commutation advice process,the lack of rights of criminals in the proposed commutation procedure in prisons,and the failure of the procuratorate to exercise substantive supervision,and analyzes the main reasons for this,as stipulated by law.Unclear and inconsistent,the procuratorial personnel of the garrison were assimilated,etc.On this basis,it discussed how the X prison commutation recommendation procedure was further regulated,improved the conditions and standards for mitigation proposals,improved the scoring assessment system,and granted criminals with legislation.The right to know,complain and participate in the commutation procedure,and the prosecutor's office's supervision over the proposed procedures for commutation of commuted prisons shall be used to improve the existing procedures for commuting commuted prisons.
