Research On The Criminal Trial Objection Rules

As a rule objection supporting institutional rules of cross-examination,Its main function that is to review the evidence specification or not,excluding the incapable evidence helps to identify case facts.Meanwhile,objection rule helps improve efficiency and orderly trial investigation,is an important part of the trial evidence investigation system.Therefore,building objection in line with the rules of the criminal trial,the characteristics of China's very necessary,but our existing objection rule is not perfect,the need for reform,build in line with the demand of our criminal trial objection rules.This paper intends to analyze and summarize the rules of objection of different countries,and divide the mode of objection rules into party-dominated complete objection rules and non-participant-dominated incomplete objection rules,and then seek objection rules suitable for the characteristics of our country's criminal trial model.According to the present situation of China's legislation,combined with the operation of objection rule in our criminal trial,the author believes that china should establish a regular pattern compromise objection,and accordingly improve the basic content of china's objection rules,and build supporting system,allow the objection rules to play its due role in our criminal trial.
