Private lending has a long history:in China, and modern society still exists and plays an increasingly significant role in the financial markets of the entire country. However, due to its lack of formal legal status, and no specific legislation to regulate it,many problems arise in the course of operations.Regarding the issue of private lending,we should pay sufficient attention to it,speed up the process of resolving the interest rate regulation problem of private lending, and timely and effectively respond to the requirements of the financial market system for informal lending, satisfying large numbers of SMEs,individual industrial and commercial households,Private individuals demand for the loan market. The author believes that the government will issue a "Lending Regulations" specifically for private lending as soon as possible. It will regulate regulations at the legislative level and improve the legal basis of private lending. It will construct a corresponding legal system for private lending, and collect and analyze market data from lending market access and lending. To strengthen the supervision and management of the lending market, etc.,to enable private lending to operate more regulated under the framework of the system,to reduce the cost of borrowing transactions more effectively, and to protect the healthy development of private lending from the perspective of structure;to distinguish productiveness in judicial practice.Types of operating borrowings are stratified for different types of lending rates, and are treated differently for different situations. In the law-based loans and credit laws, private lending is eventually incorporated into the framework of the rule of law to solve the problems and promote the healthy and effective operation of the entire country's financial system.
