A Study On Legal Protection Of Reproductive Right Under The Cloud Computer Circumstance

Cloud computing is a new product in the development of computer technology.It's a huge breakthrough in computer technology area.In fact,cloud computing has infiltrated a large number aspects in our daily life.However,we have not noticed that almost all kinds of software application stores,web mailbox are the fruits of cloud computing technology application.The application and development of cloud computing technology has brought great changes to the dissemination and acquisition of works.It has changed the traditional way of obtaining the resources of works,and has brought new problems of protecting copyright owners' rights.With the emergence and development of cloud computing technology,the traditional replication right protection system is facing an unprecedented difficulty.Based on the practical problems in reality,this paper studies on the protection system of replication rights in cloud computing environment,analyzes the existing problems,and puts forward corresponding solutions.This paper includes four sections.The first part mainly introduces the new development of replication right in the cloud computing environment,analyzes the characteristics and mode of cloud computing,even the historical evolution of the traditional copyright.This paper discusses and points out the new changes of replication rights in cloud computing environment which will enable readers to understand cloud computing technology and transfer information.The content of replication rights and the new development of replication rights in cloud computing environment form a certain understanding,which lays a foundation for the following parts.The second part mainly analyzes the difficulties faced by the protection of replication rights in the current cloud computing environment in China.It mainly includes two aspects.On the one hand,the definition of temporary replication in cloud computing environment.The problem of temporary replication is becoming more and more serious in the cloud computing environment area,but the current legislation in our country has omitted in the regulation of temporary replication.This makes it very difficult to protect replication rights in cloud computing environment.On the other hand,it is difficult to identify the tort liability of replication rights in cloud computing environment including the principle of imputation.The third part mainly compares the system and practice of international treaties and foreign legislation on the legal protection of replication right in cloud computing environment,moreover analyzes the beneficial experiences which provides a reference for the protection of replication right in cloud computing environment in our country.The fourth part is the principal part,through the above elaboration,put forward the suggestions about protecting the rights of cloud computing environment in our country,meanwhile,the traditional replication right application scope will carry on the extension and bring the temporary replication into the cloud computing environment replication right category.In order to balance the development of cloud computing technology with the protection of copyright and perfect the tort responsibility system,we should perfect the system and provide a more superior creative environment to copy right owners.
