On Chang Tsai's Legal Thought

Chang Tsai was one of the founders of Neo-Confucianism in the Northern Song Dynasty and the founder of Guan Xue,and had a very important influence on the development of Neo-Confucianism in the Northern Song Dynasty.He also put forward the monism of Qi,as well as the ontology of the universe,on the basis of which he put forward the view that the universe is a big family and that mankind is its son.And the thought of "the unity of heaven and man",Chang Tsai combined this kind of thought of heaven and earth,the universe,yin and yang,and the rigid and soft thought with ceremony,and promoted the previous Confucian thought to the realm of heaven,earth,and man's harmony.In the Northern Song Dynasty,when the feudal society began to decline,Chang Tsai rebuilt the social order and improved the current situation of the poor and weak society.This paper focuses on Chang Tsai i's legal thought and provides a reference for the legal reform of today's legal system.The content of this article is divided into the following three parts:The first part is the background and theoretical basis of Zhang Zai's legal thought.The latter part mainly expounds that the blending of Confucianism,Buddhism and Taoism is the foundation of Zhang Zai's legal thought,especially the Confucian thought has the greatest influence on the formation of Zhang Zai's legal thought.The second part is the main content of Zhang Zai's legal thought.Zhang Zai advocated the restoration of corporal punishment and the replacement of the death penalty with corporal punishment.He believed that this would reduce the loss of labor;in crime prevention,he proposed to curb people's desire.He thought that if he did not want it,he would not steal it;economically,he advocated the implementation of the well field system.Nationalizing the land and distributing it evenly among farmers,he also denied Wang Anshi's law on market change,arguing that it would create a monopoly on the market by the government,but advocated free trade.The third part is the evaluation and Enlightenment of Zhang Zai's legal thought.This part is the basis of the first two parts,the legal thoughts of Zhang Zai do evaluation,advantage is on the social order reconstruction is very useful,but some thought and slightly conservative.Finally the writer points out the thought of building a harmonious society in contemporary society,culture with reference to the excellent moral citizens.
