Discussion On The Legal Issues Of Copyright In The Broadcast Of Sports Events

Nowadays,the sport industry has huge economic benefits,but there are also many legal problems in this industry.Sport broadcasting is a very important and complicated process in the sport industry.The existing researches about this process frequently mention "sport broadcasting right",but most of these studies are not detailed and too extensive."Sport broadcasting right" should be a collection of rights rather than a single right.Throughout the broadcast process,this collection of rights involves a variety of legal relationships related to copyright legal relations.This thesis's purpose is to study the legal issues related to copyright legal relations.This thesis is divided into five main parts,the logical starting point is the legal relationships about copyright of sports events broadcast and summarizes rights of the legal relationships.Then it discusses the nature and protection of the rights as the clue of the article and puts forward some constructive suggestions on how to solve the existing legal problems.Firstly,this thesis analyzes the main process of sport broadcasting and the three legal relationships about copyright in these process,concludes the elements of these legal relationships.Then,by using the methods that comparing domestic and overseas theories and legal justification to distinguish the different rights whcih relate to intellectual property in the process of sport broadcasting and explore their natures;And then,this thesis cites example called "TiAoDongLi v.whole potatoes." to analyze the various rights which are mentioned in the previous discussion.This analysis can prove author's views,and pave the way for the following discussion.Based on the above-mentioned contents,this thesis uses the method of theoretical analysis and case study to discuss the protection status of these rights.This thesis especially lists the three major internet torts which program producers suffered and discuss the conservation status.Finally,this thesis puts forward some opinions about how to improve protecttion level of above-mentioned rights.I hope that we can provide some furtherance to protect the legitimate rights and interests of the relevant stakeholders in the sport event broadcast process better by this research.
