The Research On The Connection Between Supervisory Power And Judicial Power

After the reform of the state supervision system,the supervisory committee was set up nationwide and formed a comprehensive coverage of the national monitoring system.The Supervisory Committee exercises the supervisory power on behalf of the state,so as to transform the political system of our country from the original "one government,two houses" into a new "one government,one committee,two chambers"structure.The core of supervisory power is the right to investigate the crime of duty.At present,the connection between the supervisory power and the judicial power is a hot issue in the reform of the state supervision system,mainly dealing with the relationship between the supervisory power and the procuratorial power and the judicial power.This paper consists of the following four parts:The first part is the general theory of supervisory power and judicial power.First of all,it explains the nature of supervisory power and its exercising organs.Secondly,on the basis of judicial power,the procuratorial power and judicial power are introduced in detail.Thirdly,a comparative analysis of the similarities and differences between supervisory power and procuratorial and judicial power is made,and the relationship between restriction and supervision between the three powers is further explored.The second part discusses the nature of the right to investigate in the supervisory power.First of all,the reason for the right of investigation is expounded,and its attributes are analyzed on the basis of this.Then,in the exercise and operation of the current investigation power,the possible problems and contradictions are analyzed.Finally,suggestions are made for the existing problems.The third part is the discussion of the connection between supervisory power and procuratorial power.First of all,the articulation of jurisdiction in job-related crimes is described.Secondly,how to link up the procuratorial organs after exercising their powers of investigation.The second is the comparative analysis of the connection between supervisory organs and procuratorial organs in the compulsory measures.The fourth part is the discussion of the connection between supervisory power and judicial power.Firstly,it analyzes the application and exclusion of evidence collected by supervisory organs,and then explains the rules of handling cases in court.
