On Perfecting The System Of Lost Property Lost In China

With the continuous advance of the socialist market economy in China,people's lives have gradually changed.In order to meet the growing material needs of the public,the diversified transportation tools facilitate the daily travel of the citizens.Although the development of economy has improved people's living standard steadily,the common phenomenon of lost articles still exists in large numbers,and the range of lost property also expands.China as early as the 2007 introduction of the "property law",has made the corresponding provisions of the lost property system,but the existing provisions still exist some shortage,the effect of law enforcement is not ideal.Therefore,it is necessary to study China's current system and to perfect the lost property.This paper mainly through the method of analysis and literature research to study the rule of lost property in China,and demonstrates the methods of hermeneutic circle,comparative analysis based on the outside of the lost property finding system.Finally,combining the actual conditions of our country to solve the problems existing in the system of picking up the lost property in China,on the basis of foreign legislation on the proposed suggestions to perfect the system of lost property.The article is divided into four parts.In the first part,the concept of lost objects is introduced,the scope of the lost objects is summarized,and several special lost objects are emphatically analyzed.Then several kinds of concepts that are easy to be confused with the lost objects are compared.Finally,on the subject of lost property system and property behavior are discussed.The second part mainly introduces the present our country lost property system,and analyzes the problems existing in the system.The third part,through the comparative analysis of the system of lost property in foreign countries and China's Taiwan region,summarizes the reference and Enlightenment of foreign countries and China's Taiwan region lost and found property system in china.The fourth part mainly aims at the shortcomings of picking up lost property in the system of our country,on the basis of comparison and reference,and put forward the corresponding improvement suggestions.
