Research On The Legal Protection Of Freedom Of Religious Belief Against The Background Of Anti-terrorism

Terrorism is the common enemy of all mankind.Preventing and combating terrorism is a global problem that the international community has long faced.The main terrorist groups currently threatening world security are the religious terrorist groups,which are filled with religious fanatics.More than a decade after the September 11 terrorist attacks in the United States,the specter of terrorism has lingered.In our country,Lhasa in Tibet autonomous region from 2008 through 2009,and looting of the July 5 incident in Xinjiang,and then to 2014 Kunming railway station is spamming a fear of attack,the essence of all points to the terrorism.These activities have caused great harm to the citizens' personal and property,stable social order and public security of the country,and at the same time threaten the citizens' right to freedom of religious belief.Today,the freedom of religious belief,as one of the basic human rights,has been recognized by the international community and has been clearly protected by law.Against the background of anti-terrorism,the anti-terrorism measures taken by countries in the world in the emergency of anti-terrorism have affected the freedom of religious belief of citizens.In our country,article 36 of the constitution to protect citizens' freedom of religious belief,anti-terrorism law and criminal law amendment increases the crackdown on terrorism,but there is "terrorism" and "extreme" concept is not clear,such problems as lack of relevant procedural rules.Therefore,other general laws,such as anti-terrorism law and the provisions of the criminal law must be in accordance with the provisions of the constitution,the criminal law to and anti-terrorism law criterions for the conviction of the hitting time shall be based on the premise of respect for freedom of religious belief.Under this urgent emergency on terror to moderate reductions on freedom of religious belief,religious activities of other people's legal also wants to limit,but it must be under strict conditions,procedures,under the circumstances and reasons.This article attempts to analyze the backdrop of the freedom of religious belief in counter-terrorism,how to deal with the balance between state power and freedom of religious belief,summarizes foreign under the background of counter-terrorism experience and lessons for protection of freedom of religious belief,and improve the legal protection of the right of our country.
