Research On Legal Issues Of Cross-border Data Flow

The cross-border data flow is an important part of the current international trade,which is of great significance to the economic development of a country and the security of data.But at present,there are different international legislation and rules on cross-border data flow.There are differences in data protection legislation,data localization,law application and technology standards.These will be the short board of international trade based on data flow.After enactment of the Cybersecurity Law in 2016,the legislation and regulation of cross-border data flow is going on in depth.The personal data and important data export assessment system is introduced to promote the cross-border data to flow more orderly.But looking at the international situation,the legal regulation level of cross-border data flow in China is still far from the developed countries.At present,the EU's rigorous and systematic General Data Protection Regulations are coming into effect.International organizations such as APEC,trade organizations and some countries have advocated the free flow of data vigorously.Cross-border data flow has become an important focus of future international trade regulations.All the way,the all-round opening pattern has gradually deepened,and China's participation in global governance has become increasingly close.China urgently needs to establish a set of operative and cross-border data flow regulation system that is in line with international standards,dealing with issues such as citizen data,business communication and international cooperation to protect our international trade and data security.The first chapter of this paper expounds the basic situation of cross-border data flow and lays a theoretical foundation for further analysis of the legal regulation of cross-border data flow.The second chapter introduces the legislative practice of cross-border data flow in China,and comprehensively analyzes the historic and current situation of cross-border data flow in China.The third chapter introduces the international cross-border data flow legislation,mainly including the introduction and analysis of the cross-border data flow legislation of international organizations and regional organizations and mainly discussing its legislative characteristics and experience.The fourth chapter is the essence part of the article,which focuses on the focus of cross-border data flow legislation,and comprehensively analyzes the legal issues of cross-border data flow.The fifth chapter is the sublimation part of the article,which is related to the legal regulation of cross-border data flow in China.It is suggested that it is expected to make a modest contribution to the legal study of cross-border data flow issues in China.
