In recent years,bullying has been frequent in primary and secondary schools around the world.School bullying in primary and secondary schools has now become a common problem faced by all humans.In response to this problem,various countries and regions around the world have started to study and find effective ways to regulate the bullying behavior of primary and secondary schools.In contrast,in our country,there is no unified definition of bullying behavior in primary and secondary schools,and there are no results in regulating school bullying behavior in primary and secondary schools.Therefore,based on the scientific definition of the concept of bullying behavior in primary and secondary schools,an in-depth empirical analysis of the schoolyard bullying behavior in primary and secondary schools in China should be conducted to find out the problems existing in the school bullying behavior in primary and secondary schools in China,and to solve the problem,thus improving the degree of prevention and control of bullying behavior in primary and secondary schools in our country.First of all,school bullying is defined as: occurring in elementary and junior high schools and in the outskirts of the school,students with disparate strength engage in intentional,long-term,and repeated abuses and abuses through physical,verbal,and cyber means,causing physical or mental harm to the bullied person.Analyzed the five elements that the school bullying behavior should have: fault,injurious behavior,damage facts,causation and space.In addition,the basic features of campus bullying behaviors in primary and secondary schools are diverse,ubiquitous,complex types,hidden and serious consequences.Second,an empirical analysis of bullying behavior in primary and secondary schools was conducted.Focusing on the legal perspective,we analyzed the causes of campus bullying,including the imperfect laws and regulations on prevention and control of school bullying,the concept of “re-protection and light punishment” of minors,and the implementation of social corrective measures.Finally,in view of the problems existing in the bullying behavior of primary and secondary schools in our country,on the basis of studying the method of regulating bullying behavior in primary and secondary schools in the United States,Japan,and Taiwan respectively,and in light of the current situation in China,we propose that the bullying behavior of primary and secondary schools be taken ex-ante supervision and prevention mechanism,the emergency response mechanism and the post-mortem evaluation and summary mechanism.These three mechanisms not only completely covered the time period in which school bullying occurs in primary and secondary schools,but also integrate family,school,and society into the prevention and control of bullying behavior in primary and secondary schools.Through the interaction of these three mechanisms and mutual cooperation,the prevention and control of bullying behaviors in primary and secondary schools in our country will be accelerated.
