Study On The Legal Problems Of The Participation Of The Trade Union Of State-owned Enterprises In The Rights Of Injuries At Work

The trade union is a working class mass organization in which the workers join voluntarily and represent their interests.Trade unions,as the spokesman of the working class,defend their rights and interests is the fundamental reason and basis for their existence.In practice,trade unions defend the economic,political,cultural and social rights and interests of their workers,and the protection of injury at work is the weakest and weakest area of trade union protection.Trade unions have made some efforts to protect workers against work-related injuries,but they have done little to do so,reflecting the shortcomings of trade union organizations.In the course of writing,this paper adopts the methods of literature research,case law and comparative analysis,and discusses the participation of trade unions in industrial injury protection in four parts.First of all,it expatiates the status quo of trade union participation in the protection of injury,and has a more realistic and intuitionistic understanding of this problem.The second part analyzes the problems of labor union participation in labor injury protection,including: the unsoundness of labor union organization,the misunderstanding of labor union and the difficulty of labor injury protection.The third part analyzes the reasons why trade unions in our country are weak in protecting workers 'injuries: legal error,lack of independence of trade union organization,misplacement of relationship with government and party,and legal defect of trade union law.The fourth part puts forward the countermeasures to improve the trade union's participation in the protection of industrial injury from the angle of law:strengthen the trade union's independence,adjust the trade union's and the party's political relations,fully integrate the trade union law,improve the laws and regulations related to the protection of trade union's rights and the legislation to recognize the trade union representatives 'right of action.
