Investigation Report On The Implementation Status Of Criminal Legal Aid In Shanxi Province

The system of criminal legal aid is a necessary way to adhere to the rule of law and to build a legal government.Legal aid agencies are based on relevant laws and regulations.Organize criminal legal aid staff to provide a legal protection system for criminal defense or agency services free of charge for criminal suspects,defendants,victims,and private prosecutors who meet the conditions for aid.As the trial results of criminal cases are concerned with the core interests of the constitutional provisions such as the freedom,life,property and political rights of aid recipients.It also shows the importance of the criminal legal aid system in maintaining the balance of prosecution and defense,safeguarding judicial fairness,guaranteeing the rights of the aid recipients and safeguarding human rights.Only when the criminal legal aid system is scientifically constructed and implemented,can we really solve the problem that economically impoverished recipients cannot easily sue.Let everybody can fight for the lawsuit and let the rule of law run in the sun.The criminal legal aid system is closely related to each aid recipient.It is necessary to supplement the shortcomings of the recipient's lack of legal knowledge and to alleviate the unequal status of both the prosecution and the defense.It is important for the parties to the proceedings to be more convinced of the outcome of the trial.In addition,criminal legal aid is also beneficial to the correction of criminal suspects and defendants.Its significance lies not only in penalizing penalties for genuine repentance,but also in allowing them to return to society without hindrance after the execution of penalties.By examining the basic conditions of criminal legal aid work in Shanxi Province,the author summarized the major problems in the implementation of criminal legal aid work in Shanxi Province.Such as the orientation of aid agencies is not clear,the professional level of investigators is not enough,the funding for aid is extremely tight,and the quality of aid case defense is not effectively monitored.The author conducted a thorough investigation of aid agencies,aid lawyers,and aid recipients,and used questionnaires,data analysis,and other methods to propose directions and suggestions for improving the existing problems of Shanxi's legal aid system.It is proposed that a scientific and feasible criminal legal aid system with government-led,social support and public participation should be established in order to better implement the spirit of the criminal legal aid system in its work.
