The public security organ of our country is one of the important tools of the people's democratic dictatorship,which has the important criminal judicial power in the armed forces and plays an important role in punishing crime and safeguarding public order.In order to give full play to the functions of public security organs,the law,such as Regulations on punishment of Public Security Administration and Criminal Procedure Law,has granted the public security organs special authority and special means.Whether these powers are applied legitimately is directly related to the political stability and social stability of the country,and affects the basic personal and property rights of citizens.Therefore,the exercise of the power of the public security organs must be brought into the legal track,and we must strengthen the criminal law enforcement audit of public security.With the development of the Socialism with Chinese characteristics,the number of violations of laws and regulations by the Police has increased dramatically,such as “Nie Shubin case” and “Nian Bin case”.It reveals that the Auditing Mechanism of Police Criminal Enforcement(Hereinafter referred to as AMPCE)is not perfect.This highlights the extreme importance of strengthening AMPCE.So it is an important topic for us to comply with the new trend of the new round of national institutions,to further strengthen and improve the AMPCE,to conduct a scientific and effective review of the police's criminal law enforcement and regulate its enforcement power.Perfecting RMPCE,taking the subject as the main line,we should summarize the object,way and content.Identify the focal points for examining and restricting the criminal law enforcement power of public security organs.On the basis of contrasting the AMPCE abroad,we should learn from its advanced experience.Perfect and unify the AMPCE in China,Solving the problems existing in the current AMPCE,such as Overlap of institutions,abuse of power,inadequate performance of duties,individual warfare,structural disorder of system,waste of judicial resources,to establish a scientific,strict and effective AMPCE.
