Research On The Problems Of Transition From Enforcement To Bankruptcy Procedure

The transition from enforcement of the judgements to the bankruptcy procedure comes into courts' attention.This transition helps dealing with a large number of unenforceable cases properly,relieving the pressure of difficult enforcement,and exploring the value of the bankruptcy procedure.Improve the system of enforcement and the trial of bankruptcy cases.Transfer enterprises which meet the requirements to bankruptcy procedure,and clear away the barriers between enforcement and the bankruptcy procedure.This thesis explores the transition from enforcement of the judgements to the bankruptcy procedure,in order to benefit the system.This thesis is comprised of four parts:Part one overviews the transition from enforcement of the judgments to the bankruptcy procedure,introduces the definition,characteristics,function,and initiating modes.Part two introduce related legislation and judicial practices.Part three summarizes problems of this transition combining with foreign legislation and judicial experiences.Part four brings up solutions targeting at those problem.
