The automobile industry is a capital-intensive,technology-intensive and labor-intensive modern industry characterized by economies of scale.Since 2005,China's automobile industry has achieved rapid progress in terms of annual sales growth rate or global share in more than 10 years.However,there are also hidden risks behind considerable data.While the sales of vehicle sales continue to advance,the development of the automotive aftermarket has caused many problems.Under the 4S distribution model,automobile manufacturers often monopolize the auto aftermarket by implementing various methods,including vertical price monopoly agreements.In the anti-monopoly process of the vertical price monopoly agreement in the industry,corresponding punishments were also imposed according to the provisions of the Anti-Monopoly Law.However,when relying solely on the principle provisions of the “Anti-Monopoly Law” in China,there are often deficiencies in regulating the vertical monopoly agreements in the after-sales market of the auto industry.Therefore,how to control the vertical price monopoly of the after-sale market in combination with the unique characteristics of the auto industry within the framework of the “Anti-Monopoly Law” is worth considering.This article uses comparative analysis,empirical analysis,and literature analysis as an entry point.China's auto industry through the vertical price monopoly agreement to produce industrial policy,competition policy and legal regulations to start the three reasons.Based on the EU's exemption system and irregular inspection system,as well as the experience of the United States' forgiveness system,we will elaborate on the institutional problems that exist in China's current vertical price monopoly agreements in the automotive aftermarket in the area of anti-monopoly,and based on the four major problems that exist.Propose immature recommendations.It is mainly manifested in the specific supplements to Articles 26 and 18 of the "Administrative Measures for Automobile Sales Management",the formulation of supporting rules for the "Anti-Monopoly Law," and the promotion of the "Anti-Monopoly Guide for Automobiles",aiming to crack the vertical price monopoly agreement of the auto aftermarket in China and develop a diversified automobile aftermarket.
