Research On Dispute Resolution System Of Degree In China

The contents of the Regulations of the People's Republic of China include the degree-granting units,the conditions for awarding degrees,and the procedures for granting degrees.This degree system has been practiced in China for more than 30 years and has promoted the development of higher education in China.But since Tian Yong v.Beijing University of Science and Technology refused to grant diploma,degree card administrative litigation case to win,and become the Supreme People's Court since the ninth batch of guiding cases,in the future practice,due to degree award activities or litigation Events are endless,these events at the same time also reflects the degree of dispute resolution mechanism in China there are some problems,these problems need to be improved.This paper mainly analyzes,discusses and discusses the dispute resolution mechanism of degree awarding in China by means of case analysis,literature analysis and comparative analysis.The main content of this article is composed of five chapters.The first chapter gives a brief overview of contemporary Chinese degree and degree system,and defines and analyzes the types of degree disputes and degree disputes.Chapter II to Tian Yong v.Beijing University of Science and Technology refused to issue diplomas,degree certificates,He Xiaoqiang v.Huazhong University of Science and Technology refused to grant the degree case,Yu Yanru v.Peking University revoked doctorate case case and other typical cases from the perspective,The comprehensive analysis of disputes,and then points out the existence of dispute resolution mechanism in China.The third chapter analyzes the problems existing in the dispute settlement mechanism of our country.The fourth chapter compares and draws lessons on the dispute settlement mechanism of civil law system and case law.In the fifth chapter,the author puts forward some countermeasures to solve theproblems existing in the degree integral solution mechanism.Based on the connotation and characteristics of the degree system in our country,this paper analyzes the important causes of the dispute resolution mechanism of these places by combining the typical litigation disputes arising from the degree,and puts forward the relevant countermeasures,which is not only of theoretical significance but also more Practical significance.
