Research On The Improvement Of The Criminal Regulation System Of Internet Service Providers' Behavior

The internet information technology is changing with each passing day,especially under the background of the Internet 3.0 generation and cloud data era,various new types of cybercrime are superimposed,and internet service providers play an increasingly important role in these cyber crimes.Internet service providers use the internet to actively or passively implement various criminal activities.Compared with traditional cybercrime activities,the social harm is large and has a wide range of influence.Although China's criminal law,it regulates the behavior of internet service providers.There are still many deficiencies in the criminal law theory and judicial practice,so that the criminal behavior of internet service providers has not been effectively regulated.The author will pass the line of criminal imputation model of the behavior of internet service providers through this study,refusing to fulfill the obligations crime of information internet security management and to helping the crime of information cybercrime.and divided into five parts.The concept and classification of internet service providers,as well as the concept and characteristics of internet service providers' behaviors are carried out,through the criminal imputation model of online service provider behavior,refusing to fulfill the obligations crime of information internet security management and the crime of assisting information criminal activities,The status quo of the criminal law system for the behaviors of internet service providers is described,and the inadequacies of the current criminal law system are pointed out.Finally,the author will adopt the introduction of international conventions and the status quo of the criminal law system for the behavior of internet service providers in extraterritorial countries,to obtain inspirations and lessons from them,and put forward the perfect path for the criminal regulation system of our country's internet service provider behavior.
