Research On The Investigation Of Evidence Of Internet Fraud Crime Case

Internet fraud crime has become a key type of crime cases.Criminals commit crimes mostly cross-regionally.They have strict organization,clear-cut division of labor,low age,intelligent means,diverse forms,and refurbished means.The number of victim is large and geographical distribution covers all regions.On the whole,such cases involve a wide range of hazards,high cost of cracking down,and have difficulty in collecting evidence.This article mainly uses the methods of literature methodology,comprehensive subject,the model analysis,convention and so on,which in order to analyze and study the characteristics of this kind of case,the characteristics of the evidence and the countermeasures of investigation of evidence collection work.The first part is an overview of Internet fraud crime cases.From the perspectives of criminal law,criminology and investigation,the author has combed relevant domestic and foreign theoretical studies.On this basis,the concept of Internet fraud crime,the relationship with related crimes,and the types and characteristics of cases are analyzed and introduced,so that the characteristics of such cases can be more clearly understood.The second part is the evidence characteristics of Internet fraud crime cases.On the basis of the first part,it summarizes the main types of evidence involved in such cases,and analyzes their characteristics,laying the foundation for the investigation of evidence collection work.The third part discusses the difficulties and the reasons behind the current investigation of evidence collection work of such cases,including: the victim's poor reporting consciousness,the difficulty in collecting the cases' clues in an all-round way;the requirements of provisions of relevant evidence are too high,the standards for overseas recognition in evidence are not uniform;electronic evidence is difficult to collect and save;the professional team is weak and it is poor in investigation collaboration.The fourth part discusses the key points of investigation of evidence collection work and approaches for Internet fraud crime cases.Based on the first three parts of the study,the approaches of investigation of evidence in such cases have be refined into five major categories : domain name information flow,We-Chat?QQ and other social software information flow,capital flow,video surveillance information flow,and criminals' confession information flow,which following the traditional investigation methods of information flow and capital flow.The fifth part discusses the improvement of investigation of evidence collection work for Internet fraud crimes.According to the dilemma of investigation of evidence collection work discussed in the third part,and the actual work of investigation of evidence collection work,this part follows the aspects of technology,law,and mechanism respectively to improve investigation of evidence collection work of Internet fraud crime in the new era.Based on the existing researches of many scholars and combined with investigation work in practice,this article has certain innovations:First,it comprehensively and accurately summarizes and analyzes the main characteristics of evidence in Internet fraud crime cases,which is conducive to guiding the investigation in such cases;Second,traditional investigation methods of information flow and capital flow are refined into domain name information flow,We-Chat?QQ and other social software information flow,capital flow,video surveillance information flow,and criminals' confession information flow,which aims at providing some more specific theoretical and operational guidelines for the investigation of evidence work for the investigation organ.
