In 2015,"criminal law amendment(9)" has set "help terrorist activities","help information network crime" and "funding illegal gathering" these three help behavior to the new accusation and set up new legal punishment.This is one of the biggest amendment of help behavior in criminal law.The help behavior should have been evaluated in the common criminal system as the help of the offender,so how to understand the existence value of helping criminal offense becomes a necessary topic.The foundation of the academic foundation comes from the society.After the industrial revolution,the increasing diffusion of technical risks has made the prevention of criminal law from behind to the stage,and the trend of the predominance of the law is more and more obvious.Helping behavior is a double-edged sword,which is conducive to combating and preventing crime and protecting social stability and security.However,there are also some problems such as the low degree of typification,theconfusion of the crime system,the over-simplification of legislation and the violation of the principle of the modesty of the criminal law.The author thinks that shall be based on the principle of a legally prescribed punishment and criminal law tolerance sexual principles will help in making the scope of the strict limit,by insisting on accomplice the dependency theory,improve typed help behavior,clear indictment,carefully set up charges,legal punishment means measures such as scientific configuration,strict limits on helping behavior crime application fields,and avoid excessive criminal law of social governance,law harmonious and unified,achieve the purpose of the combination of social and individual rights protection.
