Research On The Status Of Prosecuting Zuthority In Public Interest Litigation

Public interest litigation plays an important role in protecting public interests.China's national conditions and basic systems determine the special status of the prosecuting departments in the protection of public interests.Regarding the submission of public interest litigation,China's prosecuting agencies have unique advantages compared with other litigation entities.However,public interest litigation filed by prosecuting agencies,is it a common plaintiff in civil or administrative litigation,or a prosecutor with special identity who is different from a common plaintiff?There are till different opinions between the two houses of the prosecutors and the courts during the practice.The article can be divided into three parts,whose main research direction is the prosecuting organs should be in what kind of litigation status.First of all,the concept of public interest litigation was proposed,the scope of qualifications for public interest litigation was defined,and the rationality of public interest litigation initiated was analyzed by prosecuting organs.Secondly,the article analyzed prosecuting organs' status in the public interest litigation,the existing problems and their causes.Finally,the basic concept of improving the litigation status of the prosecuting organs in public interest litigation was put forward,theposition of the “prosecutor” of the prosecuting agencies in the public interest litigation was clearly defined,and suggestions were made in the related procedure design.
